Call to Order/Roll Call

Mayor Mike Wellner called the meeting to order with the following members present: Laura Holmes, Greg Knight, Peggy Kraschnewski, Christine Weix, Dave Roiger, Mike Bub, and Clem Johnson. Alderperson Dave Brandner was an excused absence. All vote tallies will be with exception of Alderperson Brandner's vote.

Pledge of Allegiance

Alderperson Knight began the meeting by leading the group in the reciting of the “Pledge of Allegiance”.

Open Meeting Law Compliance

Mayor Wellner announced that this was an open meeting of the Common Council. Notice of this meeting was given to the public at least 24 hours in advance of the meeting by forwarding the complete agenda to the official City newspaper, The Star News, and to all news media that have requested the same as well as posting. Copies of the complete agenda were available for inspection at the City Clerk’s Office. Anyone desiring information as to forthcoming meetings should contact the City Clerk’s Office.

City Personnel Present

The following City personnel were present: City Clerk Ginny Brost, Coordinator/Public Works Director John Fales, Treasurer Kevin Doberstein, Street & Water Superintendent Joe Harris, and Building Inspector/Planner Bob Christensen. City Attorney Courtney Graff was an excused absence.

Visitors Present

Visitors present were: Brian Wilson-Star News, Val Anderson-Municipal Law & Litigation Group, Rod & Lynn Balciar, Josh Swanson-Clifton Larson Allen LLP.

Citizens & Delegations Comments

No citizens or delegations addressed the Council. Certificate of Appreciation to Rod Balciar

Mayor Wellner presented a certificate of appreciation to Rob Balciar for his many years of service to the City. Mr. Balciar retired on April 26th from his position as the Public Works Foreman. No Action Taken.

Adjourn to Closed Session #1

Laura Holmes moved, Clem Johnson seconded a motion to adjourn to Closed Session #1 at 6:05 PM in accordance with Wisconsin Statute 19.85(1)(g) to confer with legal counsel for the City who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is likely to become involved. The purpose of this Closed Session is to discuss the Wal-Mart Real Estate Business Trust 2017 and 2018 assessed value of parcel #251-01784-1503 lawsuits. Roll Call Vote: Dave J. Closed Session #1

At 6:35 PM, the Council adjourned from Closed Session #1 to Closed Session #2 in accordance with Wisconsin Statute 19.85(1)(c) & (f) to consider the employment, promotion, compensation or performance evaluation data of any public employee or which the governmental body has jurisdiction or exercises responsibility and to consider financial, medical, social or personal histories or disciplinary data of specific persons, preliminary consideration of specific personnel problems or the investigation of charges against specific persons except where 19.85(b) applies which if discussed in public, would be likely to have a substantial adverse effect upon the reputation of any person referred to in such histories or data, or involved in such problems or investigations. The purpose of this Closed Session was to discuss a City Hall employee's request for a leave of absence.

At 6:38 PM, the Council adjourned from Closed Session #2 to Open Session. Minutes

Greg Knight moved, Laura Holmes seconded a motion to approve the following minutes, and place the same on file in the Clerk's Office: (1) April 16, 2019 Council meeting. All in favor: All Aye. Motion Carried.

Wal-Mart Real Estate Business Trust 2017 & 2018 Assessed Value Lawsuits for Parcel

Greg Knight moved, Laura Holmes seconded a motion to approve the settlement agreement with Wal-Mart Real Estate Business Trust which resolves actions against the City in Taylor County Circuit Court regarding the disagreement of the assessed value of the property known as Parcel #251-01784-1503 for years 2017 and 2018 as follows: (1) The total assessed value of said property for 2017, 2018, and 2019 shall be assumed to be $6,600,000 comprised of $677,400 for land and $5,922,600 for improvements. Business Trust shall be entitled to refund payment of $42,901.67 payable within 45 days of the entry of the Order of Dismissal of the Actions. For the year 2018, Wal-Mart Real Estate Business Trust shall be entitled to a refund payment of $42,235.99 which is payable within 90 days of the entry of the Order of Dismissal. (3) The total assessed value for the year 2020 shall be assumed to be $6,500,000 (Land @ $677,400 & Improvements @ $5,822,600); for year 2021 shall be assumed to be $6,400,000 (Land @ $677,400 & Improvements @ $5,722,600). (4) The total assessed values set forth above shall not apply to the subject property in the event building or other improvements are added to the subject property during the calendar year preceding the January 1 assessment date. 2018 City Audit Including the 2018 Tax Increment Finance Districts #5, #6, #7, #8, #10, #11, #12, & #13 and the Management Letter

The Committee met with Josh Swanson of Clifton Larson Allen LLP (City Auditor) to review the 2018 City Audit including Tax Increment Finance Districts #5, #6, #7, #8, #10, #11, #12 & #13 , and the “Management Letter”.

Michael Bub moved, Dave Roiger seconded a motion to accept the 2018 City audit including Tax Increment Finance Districts #5, #6, #7, #8, #10, #11, #12 & #13 Audits, and management letter as presented. Ordinance Rezoning the Alfred & Marjorie Rothmeier Property Located on the Corner of State Highway 64 and Country Road Q (Immediately South of the Sports Page) from A-1  Agricultural Forestry to C-1 Commercial

Clem Johnson moved, Peggy Kraschnewski seconded a motion to suspend Council Rules #12A & #12B, accept the Plan Commission's recommendation, and adopt Ordinance #1043 that rezones the Alfred & Marjorie Rothmeier's property located on the corner of State Highway 64 and County Road Q (immediately south of the Sports Page) from A-1 Agricultural Forestry to C­1 Commercial. Resolution Authorizing Commitment of Match Funds Relating to the City of Medford  Participation in the Community Development Block Grant - Public Facilities (CDBG-PF) Program

Council, at its April 16, 2019 meeting, adopted Resolution #1856 that authorizes the submission of a Community Development Block Grant application relating to the City's participation in the Community Development Block Grant-Public Facilities/Planning program. If approved, the

grant will help offset the cost of the Wastewater Treatment Plant Solids Handling project. This grant is one-third/two-third split with the City shared being 1/3 with the maximum grant of $1 million. The project’s estimated cost is $1.85 million, and the City’s matching share would be $850,000.As part of the application process, Council will need to approve a resolution authorizing commitment of matching funds relating to the City’s participation in the Community Development Block Grant-Public Facilities (CDBG-PF) Program.

Michael Bub moved, Dave Roiger seconded a motion to suspend Council Rules #13A and #13B, and adopt Resolution #1857 that authorizes the commitment of matching funds relating to the City's participation in the Community Development Block Grant - Public Facilities (CDBG-PF) program for the Wastewater Treatment Plant Solids Handling project with the City's matching commitment in the amount of $850,000 being allocated from the Sewer Enterprise account. City Hall Employee Leave of Absence Request

Clem Johnson moved, Peggy Kraschnewski seconded a motion to approval a City Hall employee's leave of absence request beginning May 31, 2019 and ending July 12, 2019 due to a health condition that renders the employee unable to perform the employee's job duties with the employee using accrued vacation time, personal leave, and sick leave. All in favor: All Aye. Motion Carried.

Issuance of a Parade/Special Event Permit to Taylor County Moving for a Cure

Taylor County Moving for a Cure has submitted a parade/special gathering request for their annual walk/run to be held on May 17, 2019 beginning at approximately 7 PM and ending at approximately 8 PM. City departments have reviewed the request, and had no comments.

Laura Holmes moved, Dave Roiger seconded a motion to approve the issuance of a parade/special event to Taylor County Moving for a Cure for their annual walk/run to be held on May 17, 2019 beginning at approximately 7 PM and ending at approximately 8 PM. All in favor: All Aye. Motion Carried.

Issuance of a Street Closing Permit to Barely Legal Customs Car Club

The Barely Legal Customs Car Club has submitted a request to close Wheelock Street from the alley located between Park Street and Luepke Way and Madison Street on Sunday, July 28, 2019 from 6 AM to 4 PM for the annual Car Show. City departments have reviewed the request, and had no comment.

Peggy Kraschnewski moved, Clem Johnson seconded a motion to approve the issuance of a street closing permit to the Barely Legal Customs Car Club to close Wheelock Street from the alley located between Park Street and Luepke Way and Madison Street on Sunday, July 28, 2019 from 6 AM to 4 PM for the annual Car Show. Issuance of Operator's (Bartender's) License(s)

Clem Johnson moved, Peggy Kraschnewski seconded a motion to approve the issuance of regular operator's licenses to the following for the period beginning May 8, 2019 and ending June 30, 2019 to Holly Kirker and Cheyenne Reinke. All in favor: All Aye. Motion Carried.

Coordinator's Report

The Coordinator's report was as follows: (1)An update on the Electric Utility projects was given. (2) An update on the Public Works projects was given. (3) An update on the Wastewater Utility projects was given. (4) Public Works Employee Cory Anderson has received a successful job performance evaluation. Effective May 20, 2019, his wage will increase from $21.95 per hour to $23.11 per hour. (5) Ryan Czarnezki began his employment with the City Public Works Department on May 6th.

Upcoming Meeting Schedule - The upcoming meeting schedule was distributed.

May 13, 2019 Committee of the Whole Meeting - The May13, 2019 Committee of the Whole meeting has been canceled.

May 21, 2019 Council - The May 21, 2019 Council meeting has tentatively been canceled.

May 27, 2019 Committee of the Whole Meeting - The May 27, 2019 Committee of the Whole was rescheduled to Tuesday, May 28, 2019 due to the Memorial Day holiday.
