Call to Order/Roll Call

Chairman Wellner called the Public Hearing to order at 5:00 PM. Members present: Johnson,

Hansen, Brandner, Nazer, Zimmerman & Wellner. Dixon is an excused absence.

Visitors present: Brian Wilson-Star News, Tom Radenz-REI, Michael Longsdorf -MCL

Public Hearing: To consider a request from Deanne Wells for a conditional use permit  required under Section 3.4.2.h of the Zoning Code for a 'drive-in establishment offering in-car services'. The location for this request is 909 Casement Court.

Radenz and Longsdorf reviewed the drive-thru arrangement for the new Culvers Restaurant. No other comments were made by the public.

Adjourn to Plan Commission Meeting

Johnson moved and Zimmerman seconded a motion to adjourn the Hearing at 5:05 PM. All Ayr, motion to adjourn carries (6,0,1)

Plan Commission Public Meeting

Discussion/Action: Approval of Minutes from August 5, 2019 meeting

Zimmerman moved and Brandner seconded a motion to approve the minutes as presented. All Aye, Motion carries (6,0,1)

Discussion/Action: Wells Conditional Use Permit application

Johnson moved and Nazer seconded a motion to approve the Conditional Use Permit for a drive-thru at 909 Casement Court. All Ayes, Motion to approve passes ((6,0,1)

Discussion/Action: Annexation petition from Maple Island for the ponds south of C-R 0

Christensen reviewed the annexation petition. Johnson moved and Nazer seconded a motion to recommend Council pass an ordinance to annex the Maple Island Ponds. All Aye, Motion to recommend carries (6,0,1)

Discussion: Review of A-1 Zoning of the property located at 735 S Gibson St

Christensen explained that this parcel (251-01931-0151) when annexed was classified as A-1, Agricultural. Subsequently, a single family dwelling was constructed but the zoning was not changed and remains as A-1 today. The current owner, William Wallen has questioned this classification. Christensen suggests that the proper zoning should be R-1, Single family residential and that the Commission should conduct a public hearing to correct the zoning. All agreed that this hearing should be held whenever the Plan Commission has another public hearing. NO ACTION TAKEN

Adjournment: Brandner moved and Johnson seconded a motion to adjourn the meeting at 5:16 PM. All Ayes, Motion Carried (6,0,1)
